TERMS & CONDITIONS OF SALE

This agreement constitutes a contract between parties. This order is not subject to cancellation. It is understood that the Seller is not responsible for any defects that may develop by reason of imperfect or damp surfaces or improper treatment of the materials. Verbal modification will not be recognized.

Home Unlimited will not be responsible for measurements based upon the Customer’s own measurements. The price indicated in the proposal is subject to change in the event that the actual measurements are at variance with those submitted. Any diagrams will remain the property of the Home Unlimited.

All merchandise shall remain the property of the Home Unlimited until fully paid for. All orders taken are subject to approval by the sales and credit department of the Starling Homes Inc. all merchandise is subject to prior sale.

All orders must be paid at the time of purchase. Materials are to be 100% prepaid before delivery or pickup. Special Orders require 50% deposit.

The Customer agrees to the balance of this order being processed on the credit card noted on this invoice, as a result of delinquent payment.

No order changes or cancellation are allowed unless both parties agree in writing. There is a 25% restocking fee for all returns. Returns are only taken within 30 days from the date of purchase. The Customer is responsible for delivery and return shipping charges. Special (custom made) orders can not be cancelled.

“Clearance Sale” products sold “As Is” with no warranties of any kind expressed or implied. Products sold as “Clearance Sale” are non-returnable, non-exchangeable and the Customer has to be aware that seller does not have knowledge to what are exact imperfections are.

Customers are covered by the manufacturer’s warranty. Manufacturers each have their own warranties, which may vary. Seller extends no warranties beyond the description of the goods on the invoices, and merchantability and/or all warranties of fitness for a particular use are hereby excluded.

Variegated natural stone, wood and cork are products of nature, thus every piece differs in appearance. Variances are inevitable in natural products. The Home Unlimited will not be held responsible for such variances within the product.

Customer is aware that product may take up to 2 weeks to receive, or longer for special orders or if given a production date.

Materials could be picked-up by the Customer at the showroom or a warehouse or could be delivered by third-party shipping companies to the Customer’s address. Before pickup or unload the Customer must make sure the description, size and grade of all cartons are in accordance with sales invoice and there are no damaged cartons. Any damage must be noted by Customer on the carrier’s documents and reported to Seller within 24 hours of delivery or pickup. Claims cannot be made with regard to description of materials or to the damaged goods after pick-up or delivery.
